Marriage License Overview

Couples planning to get married will need to first apply for and receive a marriage license. To get a marriage license, both individuals will need to:

  • Appear at the clerk's office (both individuals must be present in order to receive a license)
  • Bring a valid photo id
    • Ex. State ID/driver's license, military ID, passport or alien registration card
  • Know their social security number (the card isn't neccessary)
  • Be at least 18 years old
    • If the couple is 16 or 17, they must provide a parental consent form
  • Read the Family Law Handbook
  • Pay the marriage license fee

Fees & Discounts

Couples who choose to attend a 4 hour, approved premarital course will receive a discounted marriage license fee rate if they present the certificate of completion to the clerk's office at the time of their application.

Marriage License Use & Restrictions

After a marriage license is issued, there is a 3-day waiting period before a valid ceremony can be performed. However, couples who have attended a premarital course will have the waiting period skipped. Even if only one individual from the couple is a Florida resident, the waiting period rules will still apply. Anyone wishing to skip the waiting period must provide the certificate of completion to the county clerk at the time of their application. If both individuals are non-Florida residents, there is not a waiting period. Once a couple receives their marriage licenses, it will be valid for 60 days from the date it was issued. Used marriage licenses must be returned to the clerk's office within 10 days, following of the ceremony.
